Terms of Use and Sale

Last updated: October 12, 2026

These Terms of Use and Sale ("Terms") govern your use of the HeyCal app, the heycal.app website and the HeyCal account, as well as the HeyCal Premium subscription. They form the contract between you and ROCKET SOCIAL, the publisher of HeyCal. Please read them carefully before using the service. This English version is a translation: the French version, available at /cgu, prevails.

In short

  • HeyCal is only for people aged 16 and over.
  • After the onboarding questionnaire, the app requires a HeyCal Premium subscription: €29.99 per year with a 3-day free trial, or €7.99 per month, with no commitment. It renews automatically. You can cancel it in your Apple account settings, at least 24 hours before it renews.
  • The calories and macronutrients shown are estimates, produced with the help of artificial intelligence. HeyCal is not a medical device and doesn't replace advice from a health professional.
  • The HeyCal account is optional. Without an account, your data stays on your phone. With an account, it is synced to our servers so you can access it on heycal.app and on your other devices (see the Privacy Policy).

1. Purpose and acceptance

These Terms apply to:

  • the HeyCal mobile app ("the app"), available on iPhone through the App Store, and later on Android through Google Play once it is offered there;
  • the heycal.app website ("the website");
  • the HeyCal account ("the account"), which is optional;
  • the HeyCal Premium subscription ("the subscription").

Together, they form "the service".

By downloading, installing or using the app, creating an account or taking out a subscription, you accept these Terms. If you don't accept them, don't use the service.

These Terms apply in addition to the terms of the platform you downloaded the app from (Apple Media Services Terms and Conditions or, later, Google Play Terms of Service). Section 19 sets out the terms Apple requires for apps distributed on the App Store.

2. Publisher

The service is published by ROCKET SOCIAL, a French SASU (simplified joint-stock company with a sole shareholder) with a share capital of €500, whose registered office is at 26 chemin de Chalin, 69130 Écully, France, registered with the Lyon Trade and Companies Register under number 832 329 445 ("the publisher", "we").

Contact: contact@heycal.app. Full legal information is available in the Legal Notice.

3. Eligibility

The service is only for people aged 16 and over. By using it, you confirm that you are at least 16. If we learn that a user is under 16, we may delete their account and the data associated with it.

The service is for personal, non-commercial use.

You need a compatible device, an Apple account to subscribe, and an internet connection to analyse a meal, sync your account and manage your subscription. You are responsible for the security of your device, including its passcode.

4. The service

4.1 The app

The app includes:

  • an onboarding questionnaire (sex, year of birth, height, weight, target weight, goal, chosen pace, activity level), used to calculate an indicative daily calorie budget;
  • meal analysis from a photo or a written description, which you can then correct;
  • a meal journal, with calories and macronutrients (protein, carbohydrates, fat);
  • an energy balance that compares what you eat with what you burn, plus weight and step tracking;
  • an optional connection to Apple Health (HealthKit) and, once available, to Health Connect on Android.

4.2 The account and the website

If you create an account, your journal is synced to our servers. You can then find it on several devices and view it on heycal.app, export your data and delete your account from the website (see section 8).

4.3 Languages

The service is offered in French and English.

4.4 Changes to the service

The publisher may change features to improve the service, without substantially reducing what your current subscription includes.

5. Health notice

HeyCal is not a medical device. It is a food and weight tracking tool, intended for general wellness. It doesn't diagnose or treat any condition and gives no medical advice. It doesn't replace the advice, follow-up or care of a doctor, a dietitian or any other health professional.

The calorie budget and the pace of weight loss or gain are calculated from general formulas and the information you provide. They are indicative guidelines, not a prescription tailored to your situation.

The values shown are estimates (see section 6). Don't rely on them for decisions that require an exact measurement, such as calculating an insulin dose.

HeyCal is not suitable for:

  • people who have or have had an eating disorder (anorexia, bulimia, binge eating, etc.);
  • women who are pregnant or breastfeeding, unless under medical supervision;
  • people under 16, who may not use the service.

Talk to a health professional before making any significant change to your diet or weight, especially if you have a health condition, are on medication or have a large weight goal. If tracking calories makes you anxious or changes your relationship with food, stop using the app and talk to your doctor. In an emergency, call 112 (or 15 in France).

6. AI meal analysis

6.1 How it works

When you take a photo of a meal or describe it, the app sends the photo or the text to our analysis server, which uses an artificial intelligence model (Claude, by Anthropic) to identify the foods and estimate the portions. Calories and macronutrients are then calculated from the per-100 g values in the Ciqual table (see section 7). When no food in the table matches, for example a branded product, the value shown is the model's estimate, marked with the "≈" symbol.

The analysis results are generated by an artificial intelligence system.

6.2 Estimates to check

Analysing a photo can't tell the exact weight of the foods or hidden ingredients (oil, butter, sugar, sauce). Values may therefore differ from what you actually ate. Check the result and correct it if needed before saving it. You remain responsible for what you record in your journal.

6.3 Content you send

Only send photos or descriptions of meals. Avoid including people, documents or any other personal information. Sending unlawful content or content that infringes the rights of others is prohibited. You confirm that you hold the necessary rights to the photos you send.

You remain the owner of your photos and text. You authorise the publisher to process them only to provide the service: analysis, display in your journal and, if you have an account, syncing. They are not used to train artificial intelligence models.

An analysis may be refused, for example if the photo doesn't show food.

7. Source of nutrition data

Nutrition values come from the Table de composition nutritionnelle des aliments Ciqual 2025, ANSES, https://doi.org/10.57745/RDMHWY, Licence Ouverte / Etalab 2.0 (French food composition table, Open Licence 2.0).

HeyCal adapts these values, in particular by recalculating them for the estimated portion. These adaptations, and the estimates used when no food in the table matches, are the sole responsibility of the publisher and do not engage ANSES.

8. HeyCal account

8.1 Creating an account

The account is optional. You can create it from the app or the website, with Sign in with Apple, with Google, or with your email address and a one-time sign-in code. The account is personal: create only one and don't share it.

8.2 Syncing

When you are signed in, your journal (meals with their photos, ingredients and nutrition values, weigh-ins, profile and goals, daily steps and active energy) is synced to our servers. Without an account, this data stays only on your phone.

8.3 Security

You are responsible for access to your mailbox and to your Apple or Google account, which you use to sign in. If you think someone has accessed your account, email us right away at contact@heycal.app.

8.4 Export and deletion

You can export your data in CSV format from your space on heycal.app.

You can delete your account at any time, from the Profile tab in the app or from the website. Deletion is permanent: your account data is erased from our servers, and from backup copies within 30 days at the latest. Deleting your account does not cancel your subscription (see section 9.6).

8.5 Inactive accounts

If you don't sign in to your account for 3 years, either in the app or on the website, we delete it along with its data, after warning you by email.

9. HeyCal Premium subscription

9.1 Paid access

The onboarding questionnaire is free. After that, using the app requires an active HeyCal Premium subscription or a free trial in progress.

At present, the subscription can only be bought in the app, through the App Store, and later through Google Play once the app is offered there.

9.2 Plans and prices

The plans available on the date of these Terms are:

  • Yearly: €29.99 per year, with a 3-day free trial for eligible new subscribers;
  • Monthly: €7.99 per month.

Prices, including taxes, are shown in your local currency on the subscription screen before any purchase. They may vary by country and may change. If a price goes up, you are told in advance under Apple's rules, and you can cancel before it applies.

9.3 Ordering and payment

You choose a plan on the subscription screen, then confirm the purchase with your Apple account. The sale is made through Apple, which collects the payment from your Apple account and sends you the purchase confirmation. Payment is charged when you confirm the purchase or, with a free trial, when the trial ends. The publisher never receives your payment details.

9.4 Free trial

Unless you cancel at least 24 hours before the 3-day free trial ends, it automatically becomes a paid yearly subscription. The trial is limited to one per Apple account, under Apple's eligibility rules.

9.5 Automatic renewal, no commitment

Your subscription renews automatically for the same length, at the current price, unless you cancel at least 24 hours before the end of the current period. The renewal is charged within the 24 hours before the period ends. You can check the next renewal date at any time in your Apple account settings.

The subscription has no commitment: you can stop the renewal at any time. The current period, already paid for, remains available until it ends.

9.6 Cancellation

You can cancel at any time, in a few taps, in your account settings:

  • iPhone: Settings › [your name] › Subscriptions;
  • Android, once the app is offered there: Google Play app › Profile › Payments & subscriptions › Subscriptions.

Cancellation takes effect at the end of the current period, and you keep access until then. Deleting the app or your HeyCal account does not cancel the subscription.

9.7 Refunds and right of withdrawal

Sales are made through Apple, which handles refund requests under its own terms (https://reportaproblem.apple.com). Any statutory right of withdrawal under the French Consumer Code is exercised with Apple, under the conditions it sets. The free trial lets you try the app before paying anything.

9.8 Restoring purchases

On a new device using the same Apple account, tap "Restore purchases" in the Profile tab or on the subscription screen to get your subscription back. If you have a HeyCal account, sign in to get your journal back. Without an account, your journal stays on the old device.

9.9 End of the subscription

When your subscription ends, you no longer have access to subscriber features. Your data remains yours: the data on your phone stays there until you erase it and, if you have an account, you can still export it or delete your account from the website.

10. Licence

The publisher grants you a personal, non-exclusive, non-transferable and revocable licence to use the app and the website, for your personal needs and for as long as you use the service.

Except where the law expressly allows it, you may not:

  • copy, modify, decompile or disassemble the app;
  • systematically extract content or data from the service;
  • get around the subscription or technical protection measures;
  • query the analysis server other than through the app, in particular by automated means;
  • use the service for unlawful purposes or in breach of these Terms.

11. Intellectual property

The app, the website, the HeyCal name, logo, text, design and code are protected by intellectual property law and belong to the publisher or its licensors. No rights are granted to you other than the licence in section 10.

Data from the Ciqual table remains subject to the Licence Ouverte / Etalab 2.0 (see section 7). Your photos, your text and your journal remain your property.

12. Personal data

How your data is handled is described in the Privacy Policy.

Without an account, your journal is stored only on your device. The publisher keeps no copy: it is lost if you uninstall the app, erase your data or lose your phone without a backup, and the publisher can't restore it. With an account, your journal is also kept on our servers until you delete your account.

13. Availability of the service

The publisher strives to keep the service available at all times, but can't guarantee it. Meal analysis, syncing and the subscription depend on an internet connection and on technical providers (hosting, artificial intelligence, database, Apple). The service may be interrupted, in particular for maintenance or if a provider fails. The publisher then strives to restore it as quickly as possible.

14. Warranties and liability

You benefit from the legal guarantee of conformity for digital content and services provided for in Articles L224-25-12 and following of the French Consumer Code.

For the accuracy of nutrition estimates, the publisher has an obligation of means (best efforts): it doesn't guarantee that the values shown exactly match what you ate, nor that you will reach a weight goal, which depends on many factors.

To the extent permitted by law, the publisher is not liable for damage resulting from:

  • use of the service in breach of these Terms or of the health notice in section 5;
  • decisions about your diet or health made without the advice of a health professional;
  • an incompatible device;
  • the loss of data stored only on your device;
  • the act of a third party or force majeure.

Nothing in these Terms limits the publisher's liability for gross negligence, wilful misconduct or personal injury, or the rights you have under mandatory consumer protection law.

15. Suspension and termination

You can stop using the service at any time and delete your account. Remember to cancel your subscription (section 9.6).

The publisher may suspend or delete your account, or end your licence, if you seriously breach these Terms, in particular by getting around the subscription, misusing the analysis server or sending unlawful content. Except in an emergency or where the law requires otherwise, it will tell you beforehand and let you respond.

If the publisher stops offering the service, it will tell you at least 30 days in advance where possible, stop renewing subscriptions and give you time to export your data.

16. Changes to these Terms

The publisher may change these Terms, for example to reflect changes to the service or the law. The date of the last update is shown at the top of the page. If a change is significant, you are told in the app or by email, if you have an account, before it takes effect. If you don't accept it, you can cancel your subscription and delete your account.

17. Language

These Terms are written in French and translated into English. If the two versions differ, the French version prevails.

18. Severability

If any clause of these Terms is held invalid or unenforceable, the other clauses remain in force.

19. App Store terms

If you downloaded the app from the App Store, the following terms also apply:

  • Parties. These Terms are concluded between you and the publisher, not with Apple Inc. ("Apple"). The publisher, not Apple, is solely responsible for the app and its content.
  • Licence. The licence is limited to using the app on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. The app may also be used by other accounts associated with you through Family Sharing or volume purchasing, where these are offered.
  • Maintenance and support. The publisher is solely responsible for providing maintenance and support for the app. Apple has no obligation to do so.
  • Warranty. The publisher is solely responsible for any warranties, whether express or implied by law, to the extent not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
  • Claims. The publisher, not Apple, is responsible for addressing any claims relating to the app or your use of it, including: product liability claims; any claim that the app fails to conform to any applicable legal or regulatory requirement; and claims arising under consumer protection, privacy or similar legislation, including in connection with the use of HealthKit.
  • Intellectual property. If a third party claims that the app or your use of it infringes its intellectual property rights, the publisher, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
  • Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Contact. For any question, complaint or claim about the app: ROCKET SOCIAL, 26 chemin de Chalin, 69130 Écully, France, contact@heycal.app.
  • Third-party terms. You must comply with applicable third-party terms when using the app, such as your mobile carrier's terms.
  • Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms. By accepting them, you agree that Apple will have the right to enforce them against you as a third-party beneficiary.

20. Governing law, mediation and disputes

These Terms are governed by French law. If you are a consumer living in another European Union country, you keep the protection of the mandatory provisions of the law of your country of residence.

If there is a problem, please contact the publisher first at contact@heycal.app: we always look for an amicable solution.

If your written complaint to the publisher is not resolved, you can refer the matter free of charge to the following consumer mediator, within one year of that complaint, under Articles L611-1 and following of the French Consumer Code: [TO BE COMPLETED: name, address and website of the consumer mediator].

Failing agreement, the dispute will be brought before the competent courts. As a consumer, you may choose to bring it before one of the courts with territorial jurisdiction under the French Code of Civil Procedure or before the court of the place where you lived when the contract was concluded or when the harmful event occurred.
